Purchase Agreement
GK ACTVITIES LLC, represented by an online store www.toskin.shop (hereinafter referred to as the SELLER), publishes this Purchase Agreement, which is a sales argreement addressed to both individuals and legal entities (hereinafter referred to as the BUYER) about the following:
1. Subject of the Purchase Agreement.
1.1. The SELLER undertakes to transfer ownership to the BUYER, and the BUYER undertakes to pay and accept the order(s) from online store www.toskin.shop goods and services (hereinafter referred to as the PRODUCT).
2. The moment of accepting Purchase Agreement.
2.1 The fact of ordering GOODS from the SELLER both independently and through the operator is an unconditional acceptance of this Purchase Agreement, and the BUYER is considered as a person who has entered into contractual relations with GK ACTIVITIES LLC.
3. The price of the GOODS.
3.1. Prices in the online store are indicated in the USD currency per unit of GOODS.
3.2. Tariffs for the delivery of goods are indicated at www.toskin.shop/delievery
3.3. The total amount of the ORDER, which includes paid delivery, is indicated in the "Checkout" section in the "Total" line.
4. Payment for the GOODS.
4.1. In the case of non-cash payment, the BUYER's obligation to pay the price of the GOODS is considered fulfilled from the moment of debiting funds in the amount of 100% (one hundred percent) of the prepayment from the BUYER's bank account or from an account on another online payment platform that provides payment services to the public in accordance with current legislation, including using electronic money funds.
4.2. THE GOODS are delivered to the BUYER in quantity corresponding to the invoice paid by the BUYER.
4.3. The recipient of payment for GOODS is GK ACTIVITIES LLC.
5. Delivery of the GOODS.
5.1. Delivery of the GOODS to the BUYER is carried out at the address and within the time agreed by the BUYER and the SELLER when placing the ORDER, as well as in the "Delivery" section.
6. THE SELLER undertakes:
6.1.1. before concluding the Purchase Agreement, provide the BUYER with information about the main properties of the GOODS, about the price and conditions of purchase of the GOODS, about its delivery, about the payment procedure for the GOODS, about the procedure for returning the GOODS, the refunds, as well as about the period during which the offer to conclude the Purchase Agreement is valid.
6.1.2. not to disclose any private information of the BUYER and not to provide access to this information to third parties, except as provided by law.
6.1.3. provide the BUYER with the opportunity to receive free of charge consultations via the contact details specified on the store's website www.toskin.shop in the "Contacts" section.
6.1.4. The SELLER reserves the right to change this Purchase Agreement unilaterally.
7. THE BUYER undertakes:
7.1. Prior to the conclusion of the Purchase Agreement, familiarize yourself with the contents of the Purchase Agreement, payment terms, delivery terms, exchange and refund terms on the store's website www.toskin.shop
7.2. Provide reliable information about yourself (full name, phone number, email address, maliling/delievery address) and details for the delivery of the GOODS.
7.3. Pay for the GOODS within the terms specified in this Purchase Agreement.
8. Responsibility of the parties and dispute resolution.
8.1. The Parties are responsible for improper performance of this Purchase Agreement in accordance with the procedures stated by this Purchase Agreement and the local legislation.
8.2. The SELLER is not responsible for the delivery of the ORDER if the BUYER specified an incorrect delivery address.
8.3. The SELLER is not responsible if the BUYER's expectations about the properties of the GOODS were not justified.
8.4. The SELLER is not responsible for partial or complete non-fulfillment of obligations to deliver the GOODS if they are the result of force majeure.
8.5. When placing an ORDER, the BUYER is responsible for the accuracy of the information provided about her/himself, and also confirms that she/he has read and agrees with the terms of this Purchase Agreement.
8.6. All disputes and disagreements arising when the PARTIES fulfill their obligations under this Purchase Agreement are resolved through negotiations. If it is impossible to eliminate them, the PARTIES have the right to apply for legal protection of their interests.
9. Return and exchange of goods.
9.1. The BUYER's demand for the exchange or return of the GOODS is subject to satisfaction if the GOODS are of inadequate quality, the documents confirming the purchase of this PRODUCT in the online store are preserved www.toskin.shop
9.2. The BUYER's claims for return are accepted only within the specified return period of the GOODS in the "Exchange and return" section, which is 2 days from the date of receiving the goods, which implies sending the GOODS back to the SELLER within up to 2 days after receiving.
9.3 Underwear class GOODS are not allowed to be exchanged and returned. Detailed exchange and refund terms are listed in the "Exchange and Refund" section.
10. Force majeure circumstances and event beyond our control.
We will not be liable for any failure or delay in performance of any of our obligations under an Agreement that is caused by events outside our reasonable control ("Force Majeure Event"). Force Majeure Events will include any act, event, failure, omission or accident beyond our reasonable control and including the following:
• Strikes, lockouts or other industrial actions.
• Civil commotions, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
• Fire, explosion, storm, flood, earthquake, land subsidence, epidemics or other natural disaster.
• Inability to use trains, ships, aircrafts, motorised transports or other means of transportation, either public or private.
• Inability to use of public or private telecommunications systems.
• Acts, decrees, legislation, regulations or restrictions of any government or public authority.
• Strike, failures or accidents of maritime, fluvial or postal transportation, or another type of transportation.
Our obligations arising from the Purchase Agreement will be suspended during the period in which the Force Majeure Event goes on, and therefore we will be granted a deadline extension for compliance with said obligations for a period of time equivalent to the duration of the Force Majeure Event. During this time, the PARTIES have no mutual claims, and each of the PARTIES assumes its own risk of the consequences of force majeure circumstances. We will take all reasonable action to put an end to the Force Majeure Event or to find a solution that allows us to fulfil our obligations under the Purchase Agreement despite the existence of the Force Majeure Event.
11. The term of the contract.
11.1. This AGREEMENT comes into force from the moment of placing the ORDER, and ends with the full fulfillment of obligations by the PARTIES.
12. Personal data.
12.1. The User's personal data is processed in accordance with the local legislation.
12.2. The SELLER collects and processes the personal data of the BUYERS (particularly: surname, first name of the BUYER; delivery address; contact phone number, e-mail) in order to:
• fulfillment of the terms of this Purchase Agreement;
• delivery of the ordered Goods to the Buyer.
12.3. It is not considered a violation to provide information to partners, agents and third parties acting on the basis of the Purchase Agreement with the SELLER to fulfill obligations to the BUYER.
12.4. Making a PURCHASE in an online store www.toskin.shop , THE BUYER consents to the collection and processing of personal data about himself for the purpose of delivering the ordered GOODS and fulfilling the terms of this Purchase Agreement, as well as informing the BUYER about the services, conducting surveys, monitoring marketing campaigns, monitoring CUSTOMER satisfaction, polling BUYERS about the quality of SERVICES and PRODUCTS offered on the website www.toskin.shop by making phone calls, sending emails, messages, and other forms of communication.
12.5. Personal data processing means any action (operation) or a set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification) extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the need for it arose during the performance of obligations), depersonalization, blocking, deletion, destruction of personal data.
12.6. The SELLER has the right to send information, including advertising messages, to the BUYER's e-mail and mobile phone with his consent. The BUYER has the right to refuse to receive advertising and other information without explaining the reasons for the refusal. Withdrawal of consent to the processing of personal data is carried out by sending a message to hi@toskin.shop.
12.7. Only persons directly related to the execution of ORDERS have access to the personal data of BUYERS.
12.8. The SELLER has the right to record telephone conversations with the BUYER, as well as to store electronic correspondence. At the same time, the SELLER undertakes to: prevent attempts of unauthorized access to information obtained during telephone conversations and/or transfer it to third parties who are not directly related to the execution of orders.

13. Resale and distribution.
This shopping channel is restricted to consumers or the final recipients of our products, thus any professional activity of re-sale, agency or distribution of our products is prohibited.
